Rental Agreement & Terms

1. The agreement

By booking a photo booth rental with Bend Booth ("Company", "we", "us"), the person or entity making the booking ("Client", "you") agrees to these terms. The booking is confirmed once a deposit or full payment is received and the event date is reserved in our system.

2. Payment, deposits & forfeiture of booking

  • You may pay in full at booking, or pay a 50% non-refundable deposit to reserve your date with the remaining balance auto-invoiced and due 30 days after booking.
  • If the remaining balance is not paid within 30 days of the deposit, the booking is automatically forfeited, the date is released, and the deposit is non-refundable. We are not obligated to send additional reminders beyond our standard invoice and follow-up emails.
  • All payments are processed through Stripe. Returned payments, chargebacks, or failed cards may incur a $25 fee.
  • Late bookings (within 5 days of the event) include a $200 rush fee.

3. Cancellations & rescheduling

  • Cancellations made more than 30 days before the event: full payment refunded minus the 50% deposit.
  • Cancellations made within 30 days of the event: no refund.
  • One reschedule is permitted at no charge if requested at least 30 days before the original event date, subject to availability within 12 months.

4. Client responsibilities at the event

  • Provide a safe, level, weather-protected indoor or covered location of at least 10' × 10' with access to a standard 110V power outlet within 25 feet.
  • Provide reasonable access for load-in and load-out (parking, elevators, stairs noted in advance).
  • Ensure guests use the equipment appropriately and not under conditions that would damage it (e.g. food/drink on the unit, rough handling, outdoor rain/snow exposure without our written approval).
  • Notify us in writing of any unusual venue restrictions, COIs, or setup requirements at least 14 days before the event.

5. Liability for damage to equipment, props & backdrops

The Client is fully responsible and liable for any loss of, damage to, or theft of the photo booth unit, camera, lighting, props, backdrops, signage, and any other equipment provided by Bend Booth during the rental period, from setup through tear-down, except for damage caused solely by our staff's negligence.

Repair or replacement costs (at current retail value) will be invoiced to the Client and are due within 14 days of notice. This includes damage caused by guests, venue staff, weather, spills, or any third party present at the event.

6. Release of liability & assumption of risk

Bend Booth, its owners, employees, and contractors are not liable for any injury, illness, accident, property damage, or loss sustained by the Client, the Client's guests, the venue, or any third party arising out of or relating to the use of the photo booth, props, backdrops, or any equipment provided. The Client and all attendees use the photo booth and its props voluntarily and at their own risk.

The Client agrees to indemnify, defend, and hold harmless Bend Booth from any claims, damages, costs, or expenses (including reasonable attorneys' fees) arising from the rental, the event, or the actions of the Client, the Client's guests, or the venue.

In no event will Bend Booth's total liability for any claim arising out of this agreement exceed the amount actually paid by the Client for the rental.

7. Service interruptions & force majeure

We use professional-grade equipment, but in the rare event of equipment failure beyond our control, our liability is limited to a prorated refund of the rental fee for the portion of service not delivered. We are not liable for delays, cancellations, or failures caused by events outside our reasonable control (severe weather, power outage, venue issues, illness, government action, acts of God, etc.). In such cases we will work with the Client in good faith to reschedule.

8. Insurance

Bend Booth carries a $1,000,000 general liability insurance policy. A Certificate of Insurance (COI) naming your venue as additionally insured is available on request — please email at least 14 days before your event so we can issue it in time.

9. Media, photos & marketing

Photos captured at the event belong to the Client and their guests. The Client grants Bend Booth a non-exclusive license to use selected photos for portfolio, social media, and marketing purposes unless the Client opts out in writing. We never sell event photos.

10. Conduct

We reserve the right to pause or end service early without refund if our staff is subjected to threats, harassment, intoxicated interference with equipment, or unsafe conditions.

11. Governing law

This agreement is governed by the laws of the State of Oregon. Any disputes will be resolved in the state or federal courts located in Deschutes County, Oregon.

12. Entire agreement

These terms, together with the booking confirmation, constitute the entire agreement between the Client and Bend Booth and supersede any prior discussions. Amendments must be in writing.
